The Legal Blueprint for Construction in Mumbai

Whether you are executing a large-scale bungalow construction or a major structural alteration in your flat, getting the right permissions from the BMC (Brihanmumbai Municipal Corporation) or other local authorities (NMMC, TMC) is legally mandatory.

1. Intimation of Disapproval (IOD)

Despite its negative-sounding name, the IOD is actually the first stage of clearance. It contains a list of conditions (often around 30-40) that a developer must comply with before construction begins, such as NOCs from the Fire, Storm Water, and Tree departments.

2. Commencement Certificate (CC)

Once you fulfill all the conditions listed in the IOD, the authority issues the Commencement Certificate. You cannot legally dig the foundation until you have the CC. Usually, it is issued in stages (e.g., up to the plinth level first, then for the super-structure).

3. Occupation Certificate (OC)

After the building is fully constructed and ready for habitation, officials will inspect it to ensure it was built exactly according to the approved plans. If everything checks out, they issue the OC. Without an OC, water and electricity connections are either denied or charged at exorbitant commercial rates.

Interior Alterations in Flats

If you are breaking internal walls during a renovation, you need permission under Section 342 of the BMC Act to ensure you aren't damaging load-bearing columns. A qualified civil contractor can help guide you through this process to ensure your renovation is safe and legal.
