The Most Common Dispute in Mumbai Societies: Ceiling Leakage

If you live in a Co-operative Housing Society (CHS) in Mumbai, chances are you or someone you know has faced this problem: water dripping from the ceiling because of the bathroom or kitchen in the flat directly above yours. This leads to peeling paint, damp smells, and heated arguments between neighbors.

Who is Responsible for the Repair Cost? (Mumbai CHS Rules)

According to the standard bye-laws of Cooperative Housing Societies in Maharashtra:

  • Internal Leakage (Flat to Flat): If the leakage is originating from the upper floor member's bathroom (due to broken tiles, faulty plumbing, or damaged waterproofing layer), the upper floor member is 100% responsible for fixing it at their own cost.
  • External/Structural Leakage: If water is seeping from the external building walls or the society terrace, the Society Management Committee is responsible for the repairs.

What Action Can You Take?

  1. Friendly Approach: Inform the neighbor politely. Often, they aren't aware of the leakage as the water flows downwards.
  2. Society Complaint: Write a formal letter to the Society Secretary. The society must issue a notice to the upper floor member to fix the issue within a stipulated time.
  3. Legal/BMC Action: If the neighbor refuses, the society or you can file a complaint with the local BMC ward office under the BMC Act, citing health hazards and structural damage. The BMC can issue a mandatory notice to repair.

The Permanent Technical Solution

Slapping M-Seal or cement from the bottom ceiling (your flat) will never solve the problem. Water will find another path. The only permanent solution is to repair it from the source (the upper flat).

  • Step 1: Break the floor tiles of the upper flat's bathroom.
  • Step 2: Check the concealed plumbing pipes for cracks and replace if necessary.
  • Step 3: Apply chemical waterproofing (like Dr. Fixit PIDIFIN 2K) over the entire sunken slab area.
  • Step 4: Water-test the area for 48 hours to ensure zero leakage before laying new tiles.
