BMC Rules & Society Permissions for Flat Renovation in Mumbai (2026 Guide)

In Mumbai, you cannot just wake up one morning, bring in laborers, and start breaking walls in your flat. Both the Brihanmumbai Municipal Corporation (BMC) and your Housing Society (CHS) have strict regulations to ensure structural safety and avoid nuisance to neighbors.

1. What Work Requires BMC Permission?
According to Section 342 of the BMC Act, any major structural change requires prior written permission from the BMC. However, cosmetic changes do not.
❌ Work That REQUIRES BMC Approval:
- Removing or altering load-bearing walls, columns, or beams (Strictly prohibited in most cases).
- Amalgamating (joining) two separate flats into one.
- Changing the location of the bathroom or kitchen (requires changes to drainage lines).
- Enclosing a balcony to extend the living room (subject to FSI rules and society approval).
- Adding a mezzanine floor.
✅ Work That DOES NOT Require BMC Approval (Only Society NOC):
- Changing floor tiles or wall plaster.
- Renovating the bathroom (changing tiles, sanitaryware, pipes within the same location).
- False ceiling (POP) and painting.
- Changing internal wiring and switchboards.
- Modular kitchen installation.
- Making non-load bearing partitions (like a plywood or light brick wall to divide a room).
2. How to Get Society Permission (NOC)
Even if BMC permission is not required, your Co-operative Housing Society's NOC is mandatory before starting any civil work.
Steps to get Society NOC:
- Write an Application: Submit a formal letter to the Secretary/Chairman detailing the scope of work, expected start date, and completion date.
- Submit Contractor Details: Provide the ID proofs of the contractor (like AMS Civil Construction) and the laborers working on site.
- Pay the Security Deposit: Most societies charge a refundable deposit (₹10,000 to ₹50,000) to cover any potential damage to common areas like lifts, staircases, or lobbies.
- Sign the Indemnity Bond: You may need to sign an undertaking that you will not damage the building's structural framework.
3. Allowed Working Timings for Renovation ⏱️
To avoid disturbing the peace of the residents, especially senior citizens and children, societies have strict working hours.
- Monday to Saturday: Usually 9:00 AM to 1:00 PM, and 3:00 PM to 6:00 PM.
- Heavy Noise Work (Breaking/Drilling): Often restricted to 10:00 AM to 1:00 PM.
- Sundays & Public Holidays: NO WORK ALLOWED.
Note: If you violate these timings, the society can halt your work and forfeit your deposit.
4. Debris (Malba) Disposal Rules 🚛
Leaving construction debris on the road or footpath is a punishable offense. The BMC imposes heavy fines (up to ₹20,000) for illegal dumping.
- You must hire an authorized debris-removing tempo.
- Debris should be packed in gunny bags (boris) before being transported through the lift or stairs.
- Do not block the society lobby or parking area with raw materials (sand, cement) or debris for more than 24 hours.
5. Can I Remove a Wall Inside My Flat? 🧱
This is the most common question we get! The answer depends on the type of wall:
- Non-Load Bearing Walls (Partition Walls): Yes, you can remove them, but only after an inspection by a registered Structural Engineer.
- Load-Bearing Walls, RCC Columns, or Beams: NO. NEVER. Altering the RCC structure weakens the entire building and is illegal.
